1. Agreement to Terms
By accessing and using the Visit Azerbaijan website (visitazerbaijan.az) and booking our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Visit Azerbaijan provides tour operator services, including but not limited to: guided tours, accommodation booking, transportation arrangements, visa support, and custom itinerary planning for travel within Azerbaijan.
3. Booking and Payment
3.1 Reservations
Tour bookings are confirmed upon receipt of required deposit (typically 30% of total cost) or full payment, depending on the tour and booking timeline. Confirmation will be sent via email.
3.2 Payment Terms
- Deposits are non-refundable except as outlined in our cancellation policy
- Full payment is due 30 days before tour departure
- Late payments may result in booking cancellation
- We accept bank transfers, credit cards, and other methods as specified
3.3 Pricing
All prices are quoted in USD unless otherwise stated. Prices are subject to change until booking is confirmed. We reserve the right to adjust prices due to currency fluctuations, fuel surcharges, or government taxes.
4. Cancellation and Refund Policy
4.1 Cancellation by Client
- 60+ days before departure: Full refund minus deposit
- 30-59 days: 50% refund of total cost
- 15-29 days: 25% refund
- Less than 15 days: No refund
4.2 Cancellation by Visit Azerbaijan
We reserve the right to cancel tours due to insufficient bookings, force majeure, or safety concerns. In such cases, clients will receive a full refund or the option to reschedule.
4.3 Changes and Modifications
Itinerary changes requested by clients may incur additional fees. We will make reasonable efforts to accommodate changes subject to availability.
5. Travel Documents
Clients are responsible for obtaining valid passports, visas, and any required travel documents. Visit Azerbaijan offers visa support services but cannot guarantee visa approval. Visa fees are non-refundable.
6. Travel Insurance
We strongly recommend purchasing comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and personal belongings. Visit Azerbaijan is not liable for costs arising from uninsured incidents.
7. Health and Safety
- Clients must disclose relevant medical conditions or mobility limitations at booking
- Some tours involve physical activity and may not be suitable for all fitness levels
- Clients are responsible for obtaining necessary vaccinations and medications
- We reserve the right to refuse service to intoxicated or disruptive individuals
8. Liability and Disclaimer
8.1 Limitations
Visit Azerbaijan acts as an intermediary between clients and third-party service providers (hotels, restaurants, transport companies, etc.). We are not liable for the acts, errors, omissions, or negligence of these providers.
8.2 Exclusions
We are not liable for:
- Loss, damage, or theft of personal belongings
- Injury, illness, or death arising from client negligence
- Delays or changes due to weather, strikes, or force majeure
- Costs incurred due to missed flights or connections
8.3 Maximum Liability
Our maximum liability is limited to the total amount paid by the client for the specific tour. We are not liable for indirect, consequential, or punitive damages.
9. Force Majeure
We are not liable for failure to perform services due to circumstances beyond our control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, or labor disputes.
10. Conduct and Behavior
Clients are expected to behave respectfully toward guides, service providers, fellow travelers, and local communities. We reserve the right to terminate services without refund for disruptive, illegal, or dangerous behavior.
11. Photography and Marketing
Photos and videos taken during tours may be used for promotional purposes unless clients opt out in writing. Clients retain ownership of their personal photos.
12. Intellectual Property
All content on visitazerbaijan.az, including text, images, logos, and itineraries, is protected by copyright and trademark law. Unauthorized reproduction is prohibited.
13. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
14. Dispute Resolution
Any disputes arising from these Terms or our services will be resolved through good-faith negotiation. If unresolved, disputes will be subject to the laws and courts of the Republic of Azerbaijan.
15. Amendments
We may update these Terms of Service at any time. Changes will be posted on this page with an updated date. Continued use of our services constitutes acceptance of modified terms.
16. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.
